The producers of the Alec Baldwin film “Rust” are nine months late in paying the widower and son of cinematographer Halyna Hutchins, who was killed in a gun accident on set in 2021, according to a recent court filing.
Baldwin and the other producers announced a settlement of the family’s wrongful death lawsuit in October 2022. The terms, finalized in March 2023, provided for completion of “Rust” and payments to the Hutchins estate, including insurance funds and a portion of the profits.
Rust Movie Productions LLC was supposed to make the full guaranteed payments by June 13, 2023, according to a Feb. 7 filing from the estate’s attorneys.
But that has not happened, according to the filing. The estate is now considering its options, which include resuming the wrongful death lawsuit or filing a new one.

‘Rust’ Judge Might Drop Armorer Hannah Gutierrez-Reed From Gaffer’s Lawsuit, But No Final Ruling Yet
The Los Angeles judge in the lawsuit filed by Rust gaffer Serge Svetnoy said today that he agrees with the lawyers for armorer Hannah Gutierrez-Reed that she should be dropped as a defendant on jurisdictional grounds.

The family of “Rust” cinematographer Halyna Hutchins filed a lawsuit on Tuesday against Alec Baldwin and others involved in the film, alleging that reckless behavior and cost-cutting led to her death.
Hutchins was shot and killed on Oct. 21 while preparing for a scene at the Bonanza Creek Ranch near Santa Fe, N.M. In the wake of Rust producers being hit with two lawsuits stemming from the fatal shooting of that film’s Dp Halyna Hutchins, Variety reports this morning that producer Ryan Donnell Smith is co-financing a Dustin Hoffman-Sissy Spacek movie entitled Sam & Kate.

A month after cinematographer Halyna Hutchins was shot and killed on the New Mexico set of Rust by a prop gun “discharged” by Alec Baldwin, those closest to the cinematographer are holding a private ceremony to say a final goodbye.
With only family and close friends in attendance, Hutchins’ ashes will be interred this weekend at an undisclosed location.
“Halyna was the love of my life, and our loss of her has devastated our family’s dreams,” the 42-year old DoP’s husband Matthew Hutchins said Friday in a statement provided to Deadline, along with a photo of the grave marker.

The script supervisor on “Rust” filed a lawsuit against star Alec Baldwin and the film’s producers on Wednesday, saying she suffered both “physical and emotional” injuries when Baldwin shot the film’s cinematographer while preparing for a scene.
Mamie Mitchell filed the suit in the Los Angeles Superior Court and is represented by attorney Gloria Allred. In the complaint, she says she was standing just four feet from Baldwin when the gun went off.

In a scathing Facebook post yesterday, Svetnoy called out “the person who was supposed to check the weapon on the site did not do this; the person who had to announce that the loaded gun was on the site did not do this; the person who should have checked this weapon before bringing it to the set did not do it.”
