At arraignment the defendant is incorrectly charged with attempted murder in the second degree. If the victim of a serious felony like rape in the first degree is intentionally killed during the commission of the crime the perpetrator is charged with murder in the first degree. Which means a perpetrator that attempted to murder a woman he raped would be charged with attempted murder in the first degree.
