Upon returning from Mexico and Helen's assassination, Marty secured Jonah's gun in a gun cabinet and shells in a safe. It would have been impossible for Jonah to have obtained the gun and shells and join the family as he kills Mel.
The guard hands Navarro a revolver, and he walks 'free', but quickly discoverers he is not; an experienced shooter would immediately open the cylinder to check if the gun is loaded.
