When Olivia says that rape no longer has a statute of limitations in New York state, she is only partly correct. Rape in the first degree of a minor under the age of 11 hasn't had a statue of limitations for a long time, and after a law passed in 2006 rape in the first degree, regardless of the victim's age at the time of the rape, no longer has a statute of limitations. However, rape in the second degree and rape in the third degree still have a statue of limitations (charges have to be filed within five years of the rape). The only exception is if the victim is under the age of 18 at the time of the rape; then the limitations period does not begin to run until he or she turns 18 years old or until the incident is reported to law enforcement, whichever comes first.
