- "Drop Dead Diva" - "Toxic" - August 28, 2011
Jane confronts Parker, Teri confronts an old nemesis and her mom, and Fred confronts Stacy's burgeoning fame tonight.
In tonight's big case Jane and Teri stumble on a man who appears he's going to jump off a ledge. Teri calls the cops and Jane goes to talk him down. His name is Donny and he's a soil scientist and it turns out that he's lost his job, his wife, and his family because he's convinced that the company that built a new school in Calabasas, did so on toxic soil that could endanger all the students set to go there when it opens. She says she'll help him.
Unfortunately, Parker shuts her down when it's discoverd that the big-pocketed company is a client of the firm's. When Jane tries to meet with the CEO behind Parker's back he is livid and fires her.
Grayson offers to help her and they begin to cook up a plan starting with trying to find a sympathetic judge. Jane knows of a new one in town and goes to his office bearing a welcome gift and a request for an injunction. He offers her the injunction and to take her out to dinner. It's clear he's taken with her right away and he's pretty cute himself. She thanks him for the injunction but rejects the dinner off as unprofessional.
In court, Jane and Grayson think they've found a smoking gun in the fact that the CEO of the company building the school pulled his kids out and enrolled them in Encino. He, however, claims it's because he split up with his wife and the kids moved and he was trying to keep it private. The judge tries to help Jane out but ends up dismissing on the grounds that there really is no evidence.
Grayson doesn't give up though and runs down a $100k Pay Pal payment that ended up being for a necklace for the CEO's wife. It turns out the divorce was a sham for the case and he and the wife are still happily married. Jane shows photographic evidence of this to Parker but he dismisses her. She says she's appalled that he appears to be selling his integrity by the hour. He says she didn't seem to mind it when she worked there, but he does seem troubled.
The next day he meets her at a golf course that was built from the soil at the school construction that site. Without actually telling her anything he throws her an orange and she gets the message.
Back in court, on a new motion the judge admires Jane for craftily bringing, she asks the CEO to take a bite of the orange if he feels like the soil is safe. The judge won't allow that but just at that moment Parker asks for a moment with his client. He and the client confer and offer Donny a settlement. He is reunite with his wife. He's not crazy. And Parker re-hires Jane and once again proves he has a soul. She goes to thank the judge and decides to go on a date with him after all. Yay!
In the less Yay! department is the Fred and Stacy storyline. Stacy is excited that she has nabbed a guest role on a kooky cop sitcom. She does so well that she's invited back, specifically at the request of her hunky co-star Brian. She takes Fred to celebrate the good news and when she's confronted with paparazzi at the swanky restaurant she calls him her "friend." He is hurt. But instead of stewing about it, Jane counsels that he remind Stacy of his Fred-ness. He plans a night of their "greatest hits"-- famous dates from their past-- but she has to go to a fancy Entertainment Weekly party and promote the show with Brian. He is upset but she says she wishes that he would support her. So he has a poster of them printed up with the words "I Support You" printed across it and as he's hanging it Stacy is dropped off by Brian, who then kisses her-- really kisses her goodnight. Fred sees it and is heartbroken.
Teri gets herself into hot water when she and Jane attend a dating seminar run by a woman, Marcie, that was her frenemy in high school. Her motto is "don't give it away!" But when Marcie singles out Jane at the seminar and calls her pathetic, Teri stands up for her and starts saying that Marcie was a slut in high school. So Marcie sues Teri for "slander per se" an archaic law that prohibits impugning someone's sexual decency. Teri blackmails Kim into representing her by saying she won't tattle that she and Parker are back together. (She saw them latenight through the blinds.) Halfway through the case it's revealed that Teri herself started the slut rumor about Marcie in high school after Marcie turned on her and ridiculed everything about her, including the kimchee lunches made by Teri's stern mom-- who turns up in this episode. But when Marcie boasts that noone ever listened to loser Teri in high school or now, Kim realizes that's Teri's defense. Kim puts Marcie on the stand and asks if anyone at the seminar left after Teri's outburts about her being a slut or asked for their money back. Marcie says no. Kim moves for an immediate dismissal since the whole point of the charge is that you have to show some kind of loss because of the slander and Marcie herself admitted she had none. The judge dismisses the case and Teri-- and her mom-- tell Marcie off.
And finally Grayson is still dating the bar waitress Cassie and Jane remains all judgey about it. He tells Jane they're just "having fun." She finally admits that she does have a problem with it and it's because she thinks Cassie has more invested in the relationshp than Grayson does and that he will end up hurting her feelings. At the end of the episode, Cassie goes to Jane and says she broke them up and she knows it because of the language he used when breaking up with her. She tells Jane she was happy with what she and Grayson had and she was fine with it. She asks Jane the bigger question: who are you to Grayson? She says as someone who stayed with him in the hospital and helped plan his wedding it seems like she's the one with an "investment." Cassie says she doesn't like to meddle but that Jane should tell him how he really feels or move on and that she might not be sleeping with him but she's still giving it away.
