- A high-profile judge (Don McManus) asks Peter and Jared to defend him after he is arrested for having an affair with a lawyer while presiding over her cases. Sexual tension builds between Peter and Janie (Claire Coffee). - Stickler Judge Derek Kohler, who always gives the boys a hard time, hires them when he's arrested for contempt of court himself on account of an affair with D.A. Margaret Pollack, allegedly affecting his judgments. Timing is crucial, but also love's blindness. Damien Karp's study mate Lance sues the gay baseball league for disqualifying him and the winning team on account of him allegedly not being an active homosexual. Stanton Infeld steps in to fight the case even after Lance's foxy three year ex-wife is called, the key being scarily close to home.—KGF Vissers
- Open with the guys in court getting a lecture from a judge Derek Kohler about another of their unorthodox defense techniques. At this point Derek is placed under arrest for having an affair with a district attorney named Margaret Pollack. He wants them to defend him.
A college acquaintance of Damien's named Lance needs help because the gay softball league he plays in is accusing his team of heterosexual behavior. Damien is stunned that Lance is gay and initially has no interest in a "frivolous" lawsuit. Lance points out that such a case could help his standing with the gay community and boost his chances at becoming a judge.
Derek tells the guys he's being accused of presiding over Margaret's cases in 2009, but says they didn't start dating until 2010 and he's recused himself every time a case of hers got to his court. Bash pulls out a phone sex recording he made for her that with a time stamp of 2009. Margaret comes into the room and agrees with Derek's statement about their timeline. They believe somebody must have altered the time stamp.
Franklin and Bash tell the partners they're surprised Derek and Margaret would be that stupid with the affair. Derek is facing 23 years, one for each case. Damien says the team Lance plays on was in last place before he arrived and the league thinks he's a ringer. Infeld says he wants to partner with him on the case.
Janie is prosecuting Derek and Margaret. After a little bit of flirting, she tells Bash they have a night manager that can put the two together in February of 2009.
The attorney handling the softball case (who also happens to be a player on the losing team) tells Damien that the night of the victory Lance got drunk and admitted never having dated or slept with a man. The league's self-declaration form refers to gay as participating in romantic or sexual behavior. He also says that Lance was kicked out of a straight softball league just two days before joining the gay league.
Derek tells the guy he thinks the night manager is lying about recalling his and Margaret's drink orders that night. The guys think Derek should plead out, but he wants them to get creative. They go through the cases from 2009 that could be overturned if he's found guilty. One of them was a man named Julian who Derek gave five years for embezzling money from his nightclub. We see video of Julian having to be held back from attacking Derek at sentencing.
Damien tells Infeld the league wants evidence Lance is gay.
The guys visit Julian in prison. He tells them he was in a "dark place spiritually" when he threatened Derek. They ask if he has any connections to Paul, the night manager. He says no. They point out he's made calls to a burner cell phone purchased in the city where Paul lives. Julian snaps and needs to be pulled away by guards.
Infeld questions the chairman of the gay softball association, who says he doesn't think Lance is gay because he's never had a romantic or physical gay relationship. Infeld gives the chairman a "gay test," asking him about Dancing With the Stars, Kathy Griffith and yoga. Infeld points out that his test is no less arbitrary than the league's.
Damien and Infeld go with Lance to a gay bar for a drink. Lance tells Damien that he didn't sleep with all the women he thinks he slept with. Infeld mentions that Lance's ex-wife will be testifying the following day.
Janie offers Bash a lesser sentence provided he steps down from the bench. He turns her down. Bash wants to have Carmen take a close look at Margaret.
On the stand Lance's ex-wife said the stress of their respective businesses was what ruined the marriage. Damien hands her credit card receipts showing that Lance subscribed to a gay dating website for six months before their divorce. She says that was to help a friend, but he calls her out on testifying because she's really just bitter her ex-husband could never love a woman. She is tearful. But on re-direct she tells the attorney she and Lance had an active sex life throughout their marriage.
On the stand Derek testifies about his strong record as a judge. He then says his relationship with Margaret begin in February 2010, so designated because of a sexual encounter the two had. Janie tries to argue that the emotional component of the relationship must have begun earlier, showing him an email he wrote her with a winking emoticon. He says he "may" have been attracted to Margaret and says he honestly doesn't know if had any bearing on his decisions.
Carmen finds a prison guard who tells the guys Paul's cousin served time with Julian in early 2009. He hints that Margaret is having an affair with Julian, whom she tutors in French.
Damien tells Lance he thinks they're screwed if the can't find any proof of his sexuality. Lance said in the past he tried to tell somebody he was gay, but lacked the confidence to come out. Hanna tells Damien his problem has nothing to do with Lance.
Franklin and Bash meet Margaret at the prison. She denies the affair, but they catch her on calling the same cell phone connected to Julian and Paul.
The guys have Derek over and break the news about Margaret's affair. They say the prison guard confirmed it, but won't testify. They ask him for assistance catching Margaret, but Derek goes on the offensive. He tells them they're wrong and lazy for not being able to find the person who is setting him up.
Bask tells Janie that Margaret is rigging the case and she should drop it. During this conversation they start making out and clothes come off.
Infeld puts Lance on the stand. He says he couldn't "handle the consequences" of coming out. Damien takes over the questioning and brings up an event from college where Lance punched over a girl. Lance begins to cry, saying he punched Damien because he'd never be able to have him.
Franklin immediately realizes that Bash slept with Janie. Derek shows up with evidence that Margaret is planning to run away as soon as she gets him convicted.
Franklin puts Margaret on the stand and asks her if she's in love with Julian. She says no, then Franklin points out she's been getting some strange vaccinations recently. He hands her what turn out to be fake plane tickets to Morocco. When she reads Derek as the other name Julian jumps up and starts yelling that she set him up. She calls him "babe" during the exchange. Janie drops the charges and adds a charge of perjury for Margaret.
After trial Bash and Janie talk about how their sex is more adventurous than it was when they were together.
Lance receives his trophy. Damien and Infeld attend the ceremony. Lance apologizes to Damien for punching him.
