- Jeffrey the agent finds Harvey out for a jog in Central Park. He's on the cusp of signing tennis phenom Marco Mendoza and wants Harvey on it. There's just one slight wrinkle.
Sitting down over lunch, Marco explains why he wants to be emancipated from his father. He won't let him go pro. He's 16.
Donna reels from finding the long sought after document from Costal Motors with her signature on it. She's hovering over the shredder. Mike interrupts. She leaves with the memo.
Daniel urges Jessica and Harvey to hire Allison to represent the firm against the Randalls. Harvey doesn't want to.
Allison impresses Jessica by insulting her evening wear office wear. She wants Harvey out of her way, a message Jessica relays to him.
Mike brings Harvey the address. He visits Jennifer Randall, who hates him for what he did to her husband. Harvey shows her paperwork proving he's their anonymous donor. She refuses to drop the suit.
Harold tends to Louis' cat and breaks out with some serious hives. Louis thinks allergies are a sign of weakness. The cat hasn't been eating. Harold is supposed to get it to eat.
Harvey kicks Jeffrey out of his meeting with Marco and his dad, with Mike. Dad gets angry and yells the final word on the matter that Marco isn't turning pro. He leaves.
Donna goes to Rachel for someone's birthday card and overreacts wildly when she can't find it, asking why no one at the firm can keep track of anything.
Harvey expects Marco's dad to back down. Mike thinks Harvey's just after money. Harvey challenges Mike to try to change Marco's mind.
Rachel storms over to Donna with the card and slams it on her desk. She lets Donna know she didn't appreciate what she said. Rachel says she handles her business. Donna apologizes and says it's about her.
Mike sees the interchange and watches as Donna takes the folder with her name on it out of her desk. She goes to the shredder.
Mike's waiting. He unplugged the machine. He knows it's the same file she had this morning. She denies it and acts offended, but quickly drops the act. Mike wants to bring it to Harvey, because he's been operating under the assumption the file is lost. He reminds her destroying it would be a crime. She reminds him so is practicing law without a license. If she doesn't tell Harvey, he will.
Donna goes in to Harvey's office to give him the file, but before she can, Daniel and Allison come in. They're pissed he spoke to the plaintiffs without their lawyer present. Travis Tanner is going to depose everyone. He tells them to pre-dispose everyone, starting with Donna.
Mike talks to Marco, telling him his dad is just trying to protect him. Marco is worried about missing out on playing in his peak years and says it's not about the money. To argue for emancipation they have to prove his dad is an unfit parent, but Marco says he's not. Mike thinks Marco's dad loves him. Marco says his dad often blows up like he did in the conference room. Mike doesn't know what happens when no one else is around.
Allison deposes Donna, who doesn't take it seriously. Allison tries to put her at ease by relating to her, then she accuses her of hiding the memo for Harvey. Donna walks out.
Jessica assures Allison that Harvey wouldn't bury a memo. Allison wants Harvey to sign an affidavit saying the office never received the memo so she can file a motion to dismiss. She says she's doing it to cover both their butts.
Louis yells at Harold for giving his cat half and half instead of milk. "It's creamier," Harold argues.
Mike checks with Harvey; Donna still hasn't talked to him. Mike has a hospital report about injuries to Marco that Mike says were caused by his father. Mike wants to argue the case for emancipation himself.
Jessica joins them and tells them Allison is signing a motion to dismiss. She gives Harvey the affidavit to sign that they never received the memo.
Harvey's about to sign when Mike spills coffee on it. Jessica leaves and Harvey asks why he did it. Mike gives him the bad news. He can't sign the affidavit because he'd be committing perjury.
Harvey finds Donna in the ladies' room, saying not telling him was a betrayal. She waits to be fired. He explains having the memo helps him, because just having it proves he didn't bury it.
And now the bad news. She destroyed it.
Harvey tells Allison what happened. Jessica believes him. Allison argues for a deal. Harvey says regardless of what Donna did, he never saw the memo. Allison wants to try to settle before they have to disclose. Jessica tells her to set up the meeting.
In Family Court, Mike asks Mr. Mendoza about his right to discipline and if he becomes abusive and if he has a responsibility to keep Marco safe.
Mike asks about the hospital visit for dehydration. Marco was running laps as punishment after another argument over going pro. Mike gets him riled up until he swears at him and gets admonished by the judge.
Rachel finds Louis in the break room, choked up with a cat collar. He thought his cat just had a tooth ache, but he knew his hygiene was perfect. They floss every day. Louis gets choked up and says it was too late, his cat was suffering.
Louis leaves. Mike joins Rachel. She asks what's going on with Donna. He tells her she screwed up and it's not small, he expects Harvey to fix it.
Harvey points out Mike should have made Donna tell him immediately, what would have happened if Mike wasn't in the office when Allison brought the affidavit in?
Harvey tells Mike that Donna destroyed the memo. Mike has a realization about Marco and leaves. He tells him to let things go with Donna.
Allison brings Jessica the settlement offer, $5 million plus legal fees. Harvey is stripped of his senior partnership and reported him to the NY Bar. Allison thinks they should take it.
Harvey goes to Jennifer Randall's house. He tells her he's sorry, he should have known about the memo. She slams the door in his face.
Daniel thinks they have to take the deal and cut Harvey loose. She doesn't want to scapegoat him. Daniel thinks they have to do something and reminds her it happened on her watch.
Mike brings Jeffrey the emancipation papers. There's just one problem: Marco lied. Mike went to talk to his fathe., He wasn't even there when Marco ran those laps, but Jeffrey was. He realized Marco's back was against the wall because they had no cause, so he made something up, just like Donna panicked.
Jeffrey admits it, but doesn't think it matters because they won. Mike tears up the papers.
Jessica visits Harvey and tells him it's settled. He tells her he went to the plaintiffs again. She has some hard news for him.
Rachel visits Mike for a favor. She wants the signed ball from Marco, but she won't say why.
Jessica gets Daniel, and asks him to come to her office. She wants him to let Allison go because she can't win because she doesn't believe in Harvey, but Jessica does. Daniel thinks she trying to humiliate him, like she did by summoning him to her office.
"I summoned you because I wanted to understand who you were threatening earlier," she says. "(With) The fact that if I'm not careful, you'll try to take this office back."
She knows a law was broken. She's not planning to sit by and do nothing.
Rachel brings Louis Marco's tennis ball. She knows what a huge tennis fan he is. He doesn't quite manage a thank you.
Jessica goes to see Donna. Harvey was going to talk to her, but Jessica says it's her firm. "Am I being fired?" Donna asks. "Yes," Jessica says. However she feels about her and all she's done for them, she has no choice. Donna fights off tears.
She packs up her desk. Rachel, Mike and Harvey watch her go.
Mike thought Harvey would fix it.
