It should be noted that when the statute of limitations was removed for rape in the first degree in New York in 2006 the changes only were retroactive back five years. Meaning that any first degree rape that happened between 2001 and 2006 (the statute of limitations on rape one used to be five years) could be prosecuted after the new law went into effect, but any cases of rape one that happened before 2001 cannot be prosecuted because the statute of limitations had already expired before the new law took effect, and the new law cannot revive a case whose time limitation had already expired at the time the new law went into effect in 2006.
