A government agent shuts down Lickety Splitz pursuant to Missouri Statute 573.537. This portion of the law covers the regulation of sexually oriented businesses and provides for fines and imprisonment for any person refusing to comply with these provisions. Also, the premises may constitute a public nuisance and subject to civil abatement proceedings initiated by the state in a court of competent jurisdiction. The violations are alleged to be improper layout, fire hazard and ingress and egress and the agent tells Marty to take it up with the state board. The allegations would fall under municipal fire and/or building codes and not under state jurisdiction and not Section 573.537. If the license taken by the agent is the liquor license for a violation thereof a state board would have jurisdiction, but, again, not under Section 573.537. In no event could an agent summarily lift and license and close down a business without some formal complaints and after following proper procedures.
