Toby Jones is highly well-known actor and has played a variety of different characters in his career. He has played some cold and calculated sociopaths from his roles in Doctor Who (Dream Lord - "Amy's Choice"), Sherlock (Culverton Smith - "The Lying Detective") and Captain America 1 & 2 (Arnim Zola). So I believe he can have unique portrayal of the character and still have that a bit of intimidation in his voice.

Even though Patton is more known for playing comedic characters, he does look very much like The Penguin and has the right acting capabilities for the character. He can also show the intimating side with the character - with his own portrayal of M.O.D.O.K. (2021 Cartoon TV Show). He has protrayed a version of the character in the College Humour Sketch called 'Badman (A Batman Parody)', but he could play a version of the character in a more mainstream way. So he could play this in Live-Action in a film or TV show since he has the right appearance for the character; or even do voice-over in an animation project.

Roger has play a wide variety of different characters in his career and should get more noticeable as an actor (which means he's more lesser-known). One of his current roles (2022) is as Emmett 'Doc' Brown in 'Back To The Future: The Musical' - where he sounded a bit like the original actor (Christopher Lloyd) and has his own spin on the character. If he make that voice more intimated and grouchy - I think he can play a great Penguin. He has a couple of intimating characters - like in Law & Order: Special Victims Unit (Adam Cain - "Twenty-Five Acts"). So he can play the character in Live Action or in Cartoon Animation if he likes to play the character at all.
